In this terms and conditions document as well as in our privacy policy, the following terminology applies: “customer”, “client”, “you” and “yours” refer to you, the person accessing our website and accepting the terms. “The company”, “ourselves”, “we” and “us” refers to Webtamin LLC, the company owning the HighThemes brand and its products. “Party”, “parties” and “us” refers to both the customer and ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the customer in the most appropriate manner. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Licensing

All digital goods provided by HighThemes are licensed under the GNU Public License version 2.0. Our products may be used by our users on as many websites as they like.

Refund Policy

Please ask your pre-purchase questions using our contact page and we will respond very quickly.

We offer 14 days of money back guarantee if you are not satisfied with HighThemes. Within 14 days of your purchase date, If you find a defect that our support team failed to provide a solution for, we will issue a full refund.

In the following situation, we refuse refunds:

  • Theme club subscriptions
  • Wrong theme purchases
  • If you ask for a refund beyond 14 days after the initial purchase date of the product
  • If you ask refund before contacting to our technical support team to solve the issue
  • 3rd party plugin conflict. We adhere to WordPress standards, and all the issues related to third-party plugins should be addressed to them.

Refunds are made via Paypal and will be processed within 24 hours by our customer support team.

Payments

All payments are handled through third-party payment provider FastSpring. All payments due are in U.S. dollars unless otherwise indicated. Upon payment, you will have access to the chosen features immediately.

By purchasing each theme, you grant 2-year access to ongoing theme updates and supports. After two years, you can choose to get support and theme updates for more with a small yearly fee.

Limitation of Liability

Under no circumstances shall HighThemes be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if HighThemes or an authorised representative has been advised of the possibility of such damages. If your use of materials from this site results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof.

Basically, we provide you with high-quality WordPress themes, but you are responsible for what you do with our themes. 

Theme Updates

If your individual theme license is active, you can download theme updates. If you’ve purchased memberships, the updates are available to you as long as your membership is activated.

Although we keep our theme compatible with the latest available version of WordPress, but we cannot guarantee that older themes will run with future versions of WordPrss. We reserve the rights to retire older theme if we feel they are no longer capable of our offering.

Warranty

Our products are provided “as is” without warranty of any kind, either expressed or implied. We cannot guarantee they will function with all 3rd party components, plugins or web browsers. We can not guarantee that our themes will work with all browser, nor do we guarantee that our themes will be functional with all versions of WordPress. Also, we reserve the right to reject support requests for problems that occur after theme files have been modified or third party plugins have been installed.

Support

Our support covers help with setting up our products and direction on how to use our products as advertised.

Support includes:

  • Answering questions about the theme and its features;
  • Fixing bugs.

Support does not includes:

  • Customizations (anything more than a few lines of CSS);
  • Third party plugins;
  • Creating layouts/elements that are not present on the demo site.

On individual theme purchases, support service is valid for 1 year from the date of your purchase. You can extend the period from your account dashboard at any time you like.

Your Account

You are responsible for maintaining the security of your account and purchase, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with your account. You must immediately notify HighThemes of any unauthorized uses of your account or any other breaches of security. HighThemes will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Termination

HighThemes may terminate your access to all or any part of the website at any time, with or without cause, with or without notice. If you wish to terminate this agreement or your HighThemes account (if you have one), you may simply discontinue using the web site. All provisions of this agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Changes

HighThemes reserves the right, at its sole discretion, to modify or replace any part of this agreement. It is your responsibility to check this agreement periodically for changes. Your continued use of or access to the website following the posting of any changes to this agreement constitutes acceptance of those changes.
